This Act was approved after vigorous debate between<br />opponents and supporters.<br />The Act permits therapeutic abortion after a definite diagnosis<br />by three experts and a confirmation by the Legal Medicine<br />Organisation (LMO). This decision may be based on foetal<br />diseases leading to afflictions for the mother due to foetus<br />malformation or retardation, or based upon life-threatening<br />maternal diseases. Abortion may be carried out before<br />ensoulment with the woman’s consent and any liability or<br />punishment would not be directed toward the physician.<br />Offenders going contrary to the provisions of the Act will be<br />punished according to the penalties of Islamic law.<br />The Act was passed at a public session of the parliament on May<br />31, 2005, and it approved by the Guardian Council on June 15,<br />2005<br />Under the earlier law, abortion before four months was permitted<br />if the mother’s life was at risk, but her husband’s consent<br />was mandatory. The new law in Iran permits termination of<br />pregnancy during the first four months if the foetus is mentally<br />or physically handicapped or if the mother’s life is in danger.<br />According to the new law, the woman’s consent is sufficient to<br />carry out the abortion. However, three specialists must confirm<br />that the foetus is disabled or the mother has a life-threatening<br />condition. And probably raised the bar for proper investment in a children.
